The post says the sanctions prevent him from entering New York, but usually, there are special diplomatic waivers for these kinds of high-level official duties. Why wouldn't the State Department just issue a temporary permit for the vote?
Given the current military strikes on Iran and the tension in the Strait of Hormuz... do you think the US is intentionally timing this to signal a total break from international court norms? I wonder if this overlaps with the UN Security Council deadlock...
The current sanctions regime is designed to be airtight. There is no precedent for a waiver when the prosecutor is actively pursuing cases involving US personnel.
The ICC statutes actually allow for proxy voting in certain administrative emergencies. The real question is whether the presiding judge will recognize a proxy as valid for a deciding vote.
