Claiming it as territory at a rally is one thing, but actually enforcing that against the coast guards of Oman and Iran is a different story. How do you actually implement sovereignty over a channel that isn't even within your borders?
We should distinguish between a territorial claim and the current FONOPs strategy. Claiming the area as US territory would actually undermine the legal basis for conducting freedom of navigation operations in international waters.
This isn't just a legal quirk. Given that Tehran is already calling sanctions a declaration of war, claiming ownership of their front door is essentially a prompt for a full naval blockade.
The OP's concern is valid because the regime of transit passage under UNCLOS allows all ships the right of unimpeded navigation. Asserting sovereignty would likely be an attempt to shift toward innocent passage, which permits a coastal state to suspend transit for security reasons.
